The Pebble-Mix Company Pty Ltd – Terms & Conditions

1. Definitions

  • “Pebble Mix”: Our original pebble and acrylic solvent-based resin surface product, made from natural pebbles in a range of colours.
  • “Pebble-Mix 2K”: Our advanced two-component pebble and polyurethane resin system for enhanced durability and longevity, suitable for driveways, patios, paths, balconies, pool surrounds, and more.
  • “Company,” “we,” “us,” or “our”: The Pebble-Mix Company Pty Ltd.
  • “Customer,” “you,” or “your”: The purchaser of products or services from The Pebble-Mix Company.
  • “Installer”: A person or company authorised by us to install Pebble Mix products.

2. Orders & Quotes

  • All quotes are valid for 30 days and include access to our Visualizer tool to preview your chosen finish.
  • Acceptance of a quote constitutes agreement to these Terms and Conditions.
  • Orders for supply-only or supply-and-install are subject to product availability and scheduling.
  • Custom patterns for installed surfaces require a minimum 30 sqm order and attract a price premium. No returns or refunds are available for custom orders.
  • Pebble Mix bags are available in a large range of colours and sizes. Pricing is as per the current price list available at  www.pebblemix.com.au  or on request.
  • Our Gold pebbles are sourced from Australian riverbeds; all our other pebbles are imported to ensure consistent quality and supply.
  • Variations to Accepted Quotes: Any change to the scope of work requested after a quote has been accepted must be submitted in writing. Variations may affect pricing, scheduling, and completion timelines. A revised quote will be issued where applicable and must be accepted before work proceeds.

3. Payment Terms

  • Payment is due as specified on your quote — typically, a deposit is required to secure your booking, with the balance due on completion or delivery.
  • All prices quoted are inclusive of GST unless otherwise stated.
  • Accepted payment methods: EFT, credit card, cash, or as otherwise agreed.
  • Ownership of goods remains with The Pebble-Mix Company until full payment is received.

4. Delivery, Collection & Installation

  • Delivery and/or installation will be scheduled in consultation with you. Installation requires dry days; weather may affect scheduling.
  • Pickups are available by appointment only — please call to confirm: (03) 9888 9888.
  • You are responsible for providing clear, clean site access and ensuring the substrate meets minimum requirements (e.g., 75mm thickness, clean, dry, and structurally sound).
  • If the site is not ready or accessible at the scheduled time, additional charges may apply for rescheduling.

5. Product Use & Suitability

  • Our products are suitable for resurfacing existing concrete and similar stable substrates.
  • It is your responsibility to ensure the product is fit for your intended purpose. We provide guidance, but final suitability is determined by site conditions.
  • DIY customers must follow all provided instructions and safety guidelines. Incorrect installation may void warranty.
  • Safety Data Sheets (SDS): Safety Data Sheets for all chemical products (including resin binders) are available on request or at  www.pebblemix.com.au . DIY customers must read and follow all SDS guidelines before use. Some of our products contain chemical components including xylene and methylated spirits — appropriate PPE and ventilation are required.

6. Warranty

6.1 Pebble Mix – 1 Year Warranty

Coverage:

  • 1-year warranty on materials and workmanship from date of purchase or installation.
  • Covers defects in the original Pebble Mix resin binder or natural pebble aggregate.
  • Failure to bond, cure, or perform as intended when installed according to company instructions.
  • Delamination, peeling, or abnormal wear under normal residential use.

What’s Not Covered:

  • Damage from improper installation, use of non-approved tools, or failure to follow provided instructions.
  • Substrate movement, cracking, or failure of the underlying concrete.
  • Staining, discolouration, or marks from chemicals, paint, or external sources.
  • Acts of nature (e.g., flooding, tree roots, earthquakes), vandalism, or abnormal use.
  • Use in a commercial area where a maintenance program has not been established (yearly pressure wash and seal).
  • Failure to maintain the surface as recommended (see Maintenance Requirements below).

Maintenance Requirements:

  • Clean the Pebble Mix surface at least once per year with a pressure washer.
  • Reseal the surface every 18 months to 2 years using an approved sealer sold by The Pebble-Mix Company.
  • Keep records of maintenance (receipts, photos, or a log) and provide if requested.
  • Only use cleaning and sealing products approved by The Pebble-Mix Company.
  • A Care & Maintenance Guide is provided with every installation. Following these guidelines is required to maintain your warranty.

6.2 Pebble-Mix 2k – 10 Year Warranty

Coverage:

  • 10-year warranty on materials and workmanship from date of purchase or installation.
  • Covers defects in the Pebble-Mix 2K resin binder or natural pebble aggregate.
  • Failure to bond, cure, or perform as intended when installed according to company instructions.
  • Delamination, peeling, or abnormal wear under normal residential or commercial use.
  • For domestic applications only (see Section 6.3 for commercial warranty terms).

What’s Not Covered:

  • Damage from improper installation, use of non-approved tools, or failure to follow provided instructions.
  • Substrate movement, cracking, or failure of the underlying concrete.
  • Staining, discolouration, breakdown, or marks from chemicals, paint, or external sources.
  • Use in a commercial area or common area with high traffic where a maintenance program has not been established (yearly pressure wash and seal).
  • Acts of nature (e.g., flooding, tree roots, earthquakes), vandalism, or abnormal use.
  • Failure to maintain the surface as recommended (see Maintenance Requirements below).

Maintenance Requirements:

  • Clean the Pebble-Mix 2K surface at least once per year with a pressure washer.
  • Reseal the surface every 18 months to 2 years using an approved sealer (resealing is not required immediately after installation, but is required within 18 months to 2 years thereafter).
  • Keep records of maintenance (receipts, photos, or a log) and provide if requested.
  • Only use cleaning and sealing products approved by The Pebble-Mix Company.

6.3 Commercial Warranty

For commercial or high-traffic applications (including but not limited to carparks, resorts, shopping centres, industrial premises, and shared common areas), warranty terms differ from the standard residential warranty.

  • Commercial warranty terms are project-specific and will be detailed in your formal quote and contract.
  • A mandatory annual maintenance program (pressure wash and reseal) must be in place for any commercial warranty to remain valid.

6.4 Warranty Claims Process (All Products)

  • Provide proof of purchase, installation date, and (if applicable) maintenance records.
  • Include a clear description of the issue and supporting photographs.
  • We will respond within 1 week and resolve most claims on the first attempt.

6.5 Remedies

  • At our discretion, we will repair, replace, or refund the affected area or product.
  • If the claim is outside the warranty scope, we will provide a written explanation.

6.6 General Warranty Exclusions

  • Warranty is void if the product is installed, altered, or repaired by anyone other than The Pebble-Mix Company or an authorised installer, unless written consent is provided.
  • Warranty is void if the customer fails to have the surface sealed within 2 years of installation and every 2 years following.
  • No returns or refunds on custom blends, opened containers, or products not stored as recommended. Any returned resin and/or pebbles must be unopened and dry.
  • Warranty does not cover indirect or consequential losses (such as property value, inconvenience, or business interruption).

7. Additional Clauses & Disclaimers

7.1 Substrate Disclaimer

The Pebble Mix and Pebble-Mix 2K warranties do not cover failures or defects resulting from movement, cracking, or deterioration of the underlying substrate (concrete or other surfaces). It is the customer’s responsibility to ensure the substrate is structurally sound, dry, and free of contaminants before installation. The Pebble-Mix Company can provide advice but is not liable for substrate-related issues.

7.2 Environmental & Colour Variation Notice

As all Pebble Mix products are made from natural pebbles, minor variations in colour, size, and texture are normal and not considered defects. While we strive for consistency, some natural variation will occur. Over time, exposure to sunlight and weather may cause gradual fading or colour changes, which are not covered by warranty.

7.3 Force Majeure

The Pebble-Mix Company is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, supply chain disruptions, or other unforeseeable events.

7.4 Installer/Third-Party Work

This warranty is valid only if Pebble Mix or Pebble-Mix 2K is installed, altered, or repaired by The Pebble-Mix Company or an authorised installer. Any unauthorised installation, alteration, or repair voids the warranty unless written consent is provided by the company.

7.5 Insurance Disclosure

The Pebble-Mix Company holds current public liability and indemnity insurance for all manufacturing and installation activities. Customers are encouraged to ensure their own property insurance covers any incidental damage during installation.

7.6 Dispute Resolution Pathway

If a dispute arises, The Pebble-Mix Company will make every effort to resolve it promptly and amicably. If a resolution cannot be reached, either party may refer the matter to Consumer Affairs Victoria or another appropriate dispute resolution authority. Nothing in this clause limits any rights you may have under the Australian Consumer Law.

7.7 Limitation for Commercial/Heavy Use

Warranty terms differ for commercial or high-traffic applications (such as carparks, shopping centres, or industrial premises). Please refer to Section 6.3 or contact The Pebble-Mix Company for warranty details specific to your project.

7.8 Photographic Documentation

The Pebble-Mix Company takes before-and-after photographs of all installations for quality assurance and warranty documentation purposes. These photos may also be used for training, quality improvement, and marketing materials including social media, website, and print.

Customers who do not wish their project photographs to be used for marketing purposes must notify us in writing at the time of booking. We will respect all such requests.

7.9 Privacy & Data Use

Customer personal information and project images are handled in accordance with our Privacy Policy, available at  www.pebblemix.com.au/privacy . Information will never be shared with third parties except as required to fulfil your order or as required by law.

8. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to:

  • Cancel your service contract and receive a refund for the unused portion, or
  • Receive compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy to which you are entitled under the Australian Consumer Law or any other applicable legislation.

9. Returns, Cancellations & Refunds

  • Standard products may be returned within 7 days of delivery if unused and in original packaging (a restocking fee may apply).
  • No returns or refunds for custom blends, special orders, or opened containers.
  • All deposits are forfeited for cancellations after the 3-day cooling-off period.
  • Cancellations must be received in writing. If cancellation is made within the 3-day cooling-off period, your deposit will be refunded in full. After this period, the deposit is non-refundable.
  • Refunds (where applicable) will be processed within 14 days of approval.

10. Limitation of Liability

  • Subject to the Australian Consumer Law (see Section 8), our liability is limited to the replacement of faulty goods or the cost of supplying the services again.
  • We are not liable for indirect, incidental, or consequential losses, including (but not limited to) loss of property value, business interruption, or personal injury, except as required by law.

11. Intellectual Property

  • All content, product formulations, images, the Visualizer tool, and branding remain the property of The Pebble-Mix Company Pty Ltd.
  • You may not reproduce, copy, or use any materials for commercial purposes without our written consent.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.

13. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms and Conditions, together with any accepted quote, constitute the entire agreement between the parties with respect to the subject matter and supersede all prior discussions, representations, or agreements.

15. Amendments

We reserve the right to amend these Terms and Conditions at any time. The latest version will be available on our website at  www.pebblemix.com.au . Your continued use of our products or services after any amendments constitutes acceptance of the updated Terms.

  • Pebble Mix bags are $25 each for dry pebbles in Red, Grey, White, Black, Gold, and Woodstone colours only. Custom blends are not available for dry pebble bags.
  • Our Gold pebbles are sourced from Australian riverbeds. Red, Grey, White, Black, and Woodstone pebbles are imported to ensure consistent quality and supply.

    • Reseal the surface every two years using an approved sealer sold by Pebble-Mix.
    • Keep records of maintenance (receipts, photos, or a log) and provide if requested.
    • Only use cleaning and sealing products approved by The Pebble-Mix Company.
    • A Care & Maintenance Guide is provided with every installation. Following these guidelines is required to maintain your warranty.
  • Extended Maintenance Warranty:
    • If you follow the recommended maintenance schedule and provide documentation, your warranty extends to 5 years.

6.2 Pebble-Mix 2k – 10 Year Warranty

  • Coverage:
    • 10-year warranty on materials and workmanship from date of purchase or installation.
    • Covers defects in the Pebble-Mix 2k resin binder or natural pebble aggregate.
    • Failure to bond, cure, or perform as intended when installed according to company instructions.
    • Delamination, peeling, or abnormal wear under normal residential or commercial use.
  • What’s Not Covered:
    • Same exclusions as the original Pebble Mix warranty (see above).
  • Maintenance Requirements:
    • Clean the Pebble-Mix 2k surface at least once per year with a pressure washer (1200 PSI recommended).
    • Reseal the surface every two years using an approved sealer (resealing not required immediately after install, but after 2 years).
    • Keep records of maintenance (receipts, photos, or a log) and provide if requested.
    • Only use cleaning and sealing products approved by The Pebble-Mix Company.
    • A Care & Maintenance Guide is provided with every installation. Following these guidelines is required to maintain your warranty.

6.3 Warranty Claims Process (Both Products)

  • Notify The Pebble-Mix Company in writing (email sales@pebblemix.com.au or letter) during the warranty period.
  • Provide proof of purchase, installation date, and (if applicable) maintenance records.
  • Include a clear description of the issue and supporting photos.
  • We respond within 1 week and resolve most claims on the first attempt.

6.4 Remedies

  • At our discretion, we will repair, replace, or refund the affected area or product.
